TERMS AND CONDITIONS

1. Scope

These Terms and Conditions apply to all sales of original artworks, paintings, commissions, prints and creative services provided by Sarah Bischof Giuliani. By placing an order or purchasing an artwork, the buyer agrees to these terms.

2. Artworks

All original paintings and artworks are handmade and unique unless stated otherwise.

Due to the artistic process and the materials used, artworks may contain visible textures, irregularities, creases, folds, waves, pressure marks or material variations that are intentional parts of the artwork and are not considered defects.

Minor color differences may occur due to screen settings and photography.

3. Orders and Availability

An artwork is considered reserved or sold only after written confirmation and receipt of payment or deposit.

Sarah Bischof Giuliani reserves the right to refuse or cancel an order in exceptional cases.

4. Prices and Payment

All prices are listed in the stated currency.

Payments are due within 14 days unless otherwise agreed.

Payments may in some cases be processed through direct invoices, bank transfer or Stripe payment links.

Shipping costs, customs duties, import taxes and local handling fees are the responsibility of the buyer unless otherwise agreed in writing.

Late payments may incur reminder fees or legal action.

5. Shipping and Delivery

Artworks are shipped with care using appropriate packaging.

Large paintings may be shipped rolled in a tube unless otherwise agreed.

Delivery times are estimates and may vary depending on destination, customs procedures or carrier delays.

The buyer is responsible for checking local import regulations and customs requirements.

Risk transfers to the buyer once the artwork has been handed over to the shipping provider.

The ownership of the artwork transfers only after full payment has been received.

6. Damages During Transport

If an artwork arrives visibly damaged, the buyer must document the damage immediately and contact both the shipping provider and Sarah Bischof Giuliani within 48 hours after delivery.

Claims submitted later may not be accepted.

7. Returns and Cancellation

Due to the unique and original nature of artworks, all sales are generally final.

Returns, exchanges or cancellations are not accepted based on personal preference, change of mind, subjective expectations, or minor differences in color, texture, size, material characteristics, or appearance resulting from photography, screen settings, or the handmade artistic process.

Returns may only be considered in the case of significant transport damage or a material defect that was not disclosed prior to purchase and must be reported in writing within 7 days of delivery.

Commissioned artworks are non-refundable and cannot be cancelled once work has started.

8. Copyright and Usage Rights

All copyrights and intellectual property rights remain with Sarah Bischof Giuliani.

The purchase of an artwork does not transfer copyright or reproduction rights.

Collectors may display the artwork privately but may not reproduce, modify, distribute or commercially use the artwork without prior written permission.

Sarah Bischof Giuliani retains the right to use images of sold artworks for portfolio, website, exhibition, publication and promotional purposes.

9. Liability

Liability is limited to cases of gross negligence or intent.

No liability is assumed for indirect damages, customs delays, force majeure events, shipping interruptions or circumstances outside reasonable control.

10. Governing Law

Swiss law applies.

Place of jurisdiction is Switzerland.
